For the
past decade, Erick Bohlman has
represented clients from the United
States and abroad in intellectual
property matters.
Erick Bohlman's significant
representations have included
established and start-up software
developers, Internet retailers,
on-line education providers,
publishers, broadcasters and other
technology and multimedia
contractors.
THE SWEET
SPOT
Erick
Bohlman has extensive experience in
various types of intellectual
property transactions including due
diligence analyses; copyright and
trademark acquisitions, securements
and licensings; technology-based
venture capital financings;
securities offerings; and opinion
work in support of these
transactions. In this capacity, Mr.
Bohlman has negotiated license
agreements for a supplier of
security-based telemetry operations,
attained disputed trademarks for
nationwide magazine publishers,
acquired licenses from holders of
literary and musical copyrights, and
drafted development agreements for
creators of telephone, computer and
maritime technology. Erick Bohlman
has also served as production
counsel on more then ten feature
films and was the assistant
production counsel on a major cable
network television series starring
Bill Murray.
WAITING
FOR THE MAN
In
addition, Erick Bohlman has acted as
the lead attorney on complex
lawsuits involving intellectual
property and related disputes;
including trademark, trade secrets,
copyright, unfair competition,
domain name and consumer fraud
issues. For example, Erick Bohlman
served as one of the primary
attorneys for a former member of a
multi-platinum musical group in a
high profile case against the other
band members, managers and related
corporate entities. The issues
included the ownership of trademark
rights, copyrights, breaches of
fiduciary duties, appropriation of
name and likeness, and
misappropriation of corporate
assets. Mr. Bohlman was also part of
the litigation team that
successfully defended a trademark
infringement case brought against an
international magazine publisher by
another publisher using the same
magazine title. Mr. Bohlman has also
drafted and successfully argued a
motion for summary judgment in a
multi-million dollar copyright
infringement lawsuit brought against
a production company for
unauthorized use of the plaintiff’s
song in a prominent national
television advertising campaign.
BULLET
ON A WIRE
In
conjunction with his work
activities, Erick Bohlman has
regularly lectured and published on
matters of copyright and trademark
law. He continues to serve on the
adjunct faculty to several
universities where he teaches
graduate and undergraduate courses
in business law, e-commerce,
entertainment law and intellectual
property. Mr. Bohlman has written
and published law review articles on
copyright law and other
media-related topics. His article on
digital sound sampling is the first
law review article published on this
controversial topic since the courts
first addressed the issue in 1991.
By continuing to publish, Mr.
Bohlman hopes to remain a voice in
the legal community as it struggles
to face new and emerging
technology-related issues such as
piracy, online distribution and
internet broadcasting.
